We know that life events continue to unfold even when we are in the throes of a national emergency and that the need for legal advice from attorneys may emerge during these trying times. As a result of the Governor’s executive orders, the Virginia Supreme Court has severely limited access to the court system through April 26, 2020 and in some cases beyond that time.
-Almost all civil cases in this time period have been removed from the hearing docket and will be continued to later dates.
-New suits and motions can be filed since the clerk’s office remains open, and this may be advisable in those situations where retroactive relief is sought.
-If you intend to appeal a court ruling recently made, this is an important time to receive advice on how the normal process and deadlines have been affected.
-There are other potential actions that fit within the definitions of legal emergencies as defined by the Supreme Court of Virginia which may offer other forms of relief.
-In addition, mediation through teleconferencing may be available for situations where parties want to try and resolve their cases voluntarily.
